Terms and Conditions

Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean Phoenix World Travel.

Legal Information

When you make a booking with us, Phoenix World Travel, legal obligations arise and your right to refund of money charged to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of the particular supplier.

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking. Your contract will either be with us or with another supplier of travel services and this will depend on the type of arrangements you book.

Once payment is made for the booking, it is deemed that you have read and understood the terms and conditions for the booking. If you have any queries please contact us before making booking for any service.

Agency

Products and services are sold by Phoenix World Travel as an agent for airline and wholesale companies and other suppliers providing services, including accommodation and transportation services. PWT is not a provider of services and has no responsibility for services provided or not provided by any party unless any special arrangement and agreements are made with Phoenix world travel. We give and make no warranty or representation regarding the standard of any service or product to be supplied by airlines, whole seller or supplier of any kind and no person has authority to make any such representation or warranty on behalf of Phoenix World Travel. All tickets, coupons, exchange orders, vouchers and receipts are issued subject to the appropriate tariffs and terms and conditions of sale of suppliers and these terms. They are issued by Phoenix World Travel as an agent only. We have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products.

Travel Insurance:

Travel Insurance is strongly recommended by the Department of Foreign Affairs and Trade for overseas travel.

Payment - Credit Cards

When booking airfares online we can only accept credit card payment. We accept the following credit cards and will review the list of the accepted credit cards from time to time:

Payment for package holidays is accepted by cash, cheque, direct deposit or credit card. A surcharge may apply for credit card payments on these transactions.

Before we proceed to issue your airline ticket or process any travel booking on your behalf, various checks are taking place to validate the integrity of credit card information. In certain circumstances the credit card holder will be required to submit verification documentation to substantiate identity. In circumstances where we cannot contact the card holder and the ticket issuance period lapses thereby making the booking invalid, we will have no choice but to cancel the booked arrangements. Under these circumstances we accept no responsibility for any re-booking costs.

Payments by B-Pay:

Please note that BPAY takes up to 3 business days to process. If you are paying by this method you will need to make the payment at least 3 business days prior to the actual due date. You must notify your consultant of your payment once it has been made.

Payments by Cheque:

Please note that cheque payments require 5 business days to process. If you are paying by this method you will need to make the payment at least 5 business days prior to the actual due date. You agree not to stop payment of the cheque even when you cancel a booking. You agree that we may apply the proceeds of the cheque to satisfy any liability you have to us, including any liability in respect of cancellation fees, before refunding the balance to you.

Booking confirmations:

A Standard Booking Fee may be applied per person, per booking as advertised. We advise you to check your booking details in visual itinerary called “check my trip” website. Before we issue your tickets with special attention to the spelling of the names as it is in the passport and your travel schedule to avoid any complicacy. After issuing ticket if you discover any mistake we are not held responsible. If any change requires, after ticketing this may incur further fees.

Bookings from outside Australia

We reserve the right at our absolute discretion to decline or accept bookings made from outside Australia. Any booking confirmations for such bookings are conditional contingent on our view of any financial risks, potential ticket dispatch delays, or other international regulations that may apply.

Taxes:

Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.

Goods and Services Tax

Prices quoted do not include goods and services tax or similar tax ("GST"). GST is payable by you in respect of any supply made to you, and in addition to the price payable. You must pay the amount of GST payable in the respect of the supply. GST is payable at the same time and in the same manner as the price or at such later time as Phoenix World Travel may request.

NO SHOW:

Flights must be taken in the sequence they appear on your ticket or electronic ticket confirmation. If you do not check in on time for a confirmed reservation, the airline may register you as 'no-show', which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.

if you plan not to take the booked flight you may contact with us or directly with airline and discuss your options well in advance while you are in Australia and contact with the airlines directly while you are outside Australia. When you are recorded as “NoShow” by the airlines and you still intend to fly with new schedule please contact us. For rebooking, no show, administration charge, service fee and the excess travel fare will be applied.

Reject from Airlines at the airport:

If airlines reject you from boarding the flight for any reasons (for example passport expiry, visa , force majeure etc) or any other extraordinary reason, we are not responsible in any capacity.

Changes to Bookings

Where a change to your travel arrangements is permitted and possible, PWT may charge you a Standard fee. This will apply in addition to any additional supplier charges. By confirming the booking, you are accepting the specific ticket conditions relating to your chosen fare.

Changes are subject to availability and are subject to the validity of your ticket - for details check the ticket conditions in the fare selected. Not all fares allow changes, so please check your fare conditions carefully.

Changes outside the validity of your ticket, for example, to a higher season, a different airline, operator or ticketed route, where these are possible, will result in additional charges on top of Standard Change Fees.

Cancellations

Cancelled bookings may incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees will also apply where a booking is changed or tickets are reissued.

Cancellation of tickets may incur fees and in some cases it may be up to 100% of the fare. This will vary depending on the airfare you have booked. So check your specific fare rules carefully. Page 6 of 12 If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

Refunds

Your request for a refund of an airfare booked at the Phoenix World Travel is governed by the terms and conditions of the airfare you purchased and are as determined by the airlines. Many fares are non-refundable. Airline charges and cancellation fees may apply to your particular airfare.

When a refund is available there is a limit to the time in which it may be claimed. If you are not planning to travel, it is your responsibility to cancel the flight directly with the airline or notify Phoenix World Travel. Failure to do so may result in your entire booking being cancelled and you may not be eligible for a refund.

Refunds will only be paid to you once we have received the funds back from the supplier(s)/Airlines. Generally flight tickets cannot be refunded if they are partially used. This is beyond the control of Phoenix World Travel.

Rates and Price Variations

We reserve the right to vary published rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. We are not liable in any way if any increase occurs. Unless otherwise specified, rates quoted are per tour, per night accommodation, per crossing ferries, per package; as appropriate to the particular product.

Car rental is based on a 24 hour period commencing from the time of pick-up throughout unless otherwise specified. All prices are subject to availability and can be withdrawn or varied without notice.

Currency

All prices quoted in the flight booking engine are in Australian dollars, regardless of where your requested flight is departing from.

Price Inclusions and Exclusions

Items included in the prices or rates of the products are specified in each section. Prices do not include, meals other than as stated in itineraries, any air fares unless stated, Government departure taxes, passport and visa charges, vaccination fees, airport taxes, any items of a personal nature such as telephone calls, beverages, laundry, excess baggage charges and gratuities, travel insurance or other items not specified.

Special Travel Products

The terms displayed on this website apply generally to all the products and packages sold by Phoenix World Travel.

Some products also have special conditions applying to them. Airlines, hotels, wholesalers and other suppliers have various other terms and conditions relating to the purchase of these goods and services.

Some of those terms will be displayed in the Rules applicable to a particular product, but not all. For example, suppliers often limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage, however we do not have those conditions to display.

It is your responsibility to check those terms and conditions before making a booking through Phoenix World Travel.

There are numerous rules and regulations affecting most advance purchase and other discounted air fares, which involve substantial cancellation or amendment fees, and in some instances there are no refunds whatsoever on cancelled holidays and or air tickets should you need to amend or cancel your travel plans. If you have any queries regarding these fees please do not hesitate to contact our office.

You must read the Rules and check the conditions applicable to every airfare and ensure that you accept those Rules and conditions before you make a booking. If the Rules and conditions are not displayed you should contact our office. Once you confirm a booking and make payment you are bound by the Rules and conditions applicable to the relevant supplier.

Force Majeure – Changes beyond our control

Compensation will not apply if a significant change is made for reasons beyond our control. These include but not limited to :

Phoenix World Travel cannot accept liability or responsibility for any airline or supplier bankruptcy or insolvency and the failure to provide any services which may follow.

Travel Documents and Visas

All individuals departing from Australia must be in possession of a valid passport.

It is your responsibility to fulfill the passport, visa and other immigration requirements applicable to your itinerary. You need a valid passport for all international travel.

Many countries require that your passport is valid for at least six months beyond your expected period of travel. If your passport is due to expire within six months of your return arrival back in Australia then under normal circumstances you should obtain a new passport.

The name provided by you for your travel tickets must be the same as that in your passport. It is your responsibility to ensure that you have all the documentation you need for your journey.

Visas are obtained from the issuing authority in Australia and you should confirm these with the relevant High Commissions, embassies and/or consulates. Visa requirements vary by both country you are travelling to and the current citizenship you hold so please ensure you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. Either airline Staff or immigration authorities may not allow you to pass through customs and board your flight without the appropriate visa. Some countries will not allow you to enter without proof of a return or onward electronic or paper ticket. Airline check in Staff at your point of origin may deny boarding you.

If you proceed to book a one way ticket please ensure you have checked with the Consulate of the country you are travelling to in order to ensure that you comply with their laws and regulations.

We do not accept any responsibility in the case you being unable to travel due to not complying with such requirements. If you are in any doubt as to the visa requirements for your destination you may refer to an online external visa advisory service, Visa Link at http://www.visalink.com.au/.

Should you be travelling on anything other than an Australian Passport then it is your responsibility to bring this to our attention as you may require a visa or permit to re-enter Australia.

By agreeing to purchase of the tickets, Phoenix World Travel assumes that you will make arrangements for the required visas.

Phoenix World Travel cannot accept responsibility for the content or accuracy of information provided in any external websites not within Phoenix World Travel'’s control.

Travel Advice and Vaccinations

Australian residents should refer to the travel advice posted by the Department of Foreign Affairs at http://www.dfat.gov.au/ or http://www.smarttraveller.gov.au/ for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

If you are travelling to the United States:

Please see https://esta.cbp.dhs.gov for information regarding compulsory pre-registration for their visa waiver program. Please note, you may not meet the requirements of ESTA and may be required to obtain a visa.

Monies not held on trust:

All monies paid by you to us will be the property of Phoenix world Travel Limited and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided. You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you we may hold such monies in any account as we see fit, including with our own and/or other customer monies.
